PAYMENTS, REFUNDS, CHANGE OF SERVICE, and CANCELLATIONS:

All sales are final. There are no refunds for any reason. There is no trial period. We do not prorate or refund any billing charges or purchases or cancellations for any reason. All purchases and/or items purchased are irrevocable.  NaviTrader, Inc makes absolutely no representations or warranties as to any component(s), membership products and/or services and expressly disclaims all warranties, whether expressed or implied, including warranties of merchantability or fitness for a particular purpose. NaviTrader's billing policy with which all customers must comply: All accounts are set up on a prepaid basis. Payment must be received by NaviTrader before any product or service is provided/activated.  Billing is based on availability of products and services, not based on usage.

Delinquent/Deactivation Accounts: All accounts past due may be disabled until balances are paid in full. When disabled, all access will be suspended and program will be unavailable. NaviTrader may assess a $75.00 processing fee on all returned checks or chargebacks and Collections activities may proceed for collection. Collections Fee: In the event an account is submitted to a third-party collections service, a $95.00 processing fee may be assessed to the existing account balance. This fee is in addition to any other fees previously assessed on the account if past due. The purchaser agrees that any and all disputes, mediation and/or litigation will be done in Hillsborough County, FL with the purchaser responsible for any and all costs, fees, expenses, legal and/or court costs. In the event the Purchaser has questions, concerns, constructive criticism, feedback or complaints related to NaviTrader, Purchaser agrees to communicate all such issues directly to NaviTrader, and agrees to make no public statements of such issues. The purchaser consents to the exclusive jurisdiction of the federal and state courts located in Hillsborough County, Florida, in any action arising out of or relating to this agreement. The purchaser waives any other venue to which the purchaser might be entitled by domicile or otherwise. You understand and agree that NaviTrader, Inc. is not responsible for any delay or failure in your receipt of any email correspondence and/or archives we may send.  NaviTrader, Inc makes absolutely no representations or warranties as to any component(s), products and/or services and expressly disclaims all warranties, whether expressed or implied, including warranties of merchantability or fitness for a particular purpose.

For all NaviTrader™ services: You may cancel your subscription at any time, However, refunds will not be given. For example, if you paid $599 for a monthly subscription on January 1, where the monthly price was $599 and you cancelled your subscription on February 15th, you would no longer be billed as of March 1st. However, you would NOT be refunded any portion of the payment.

If you paid $3,295 for an annual subscription on January 1, where the annual price was $3,295 and you cancelled your subscription on February 15th, or anytime during that year, you would no longer be billed as of January 1st of the following year. However, you would NOT be refunded any portion of the payment.

After you become a registered Subscriber, NaviTrader™ will automatically charge your credit card each month in the case of a monthly subscription or each year in the case of annual subscriptions, at the then current subscription fee rate until you cancel your subscription through the subscription cancellation process by notifying NaviTtrader™ in writing of your cancellation. Subscription fees are not refundable for the initial subscription period or for any partial month in which a subscription is cancelled, in the case of a monthly subscription, or for any partial year in which the subscription is cancelled, in the case of an annual subscription.

If you change your service to a service with a different fee than the service to which you initially subscribed, you must cancel any unwanted services. You will be charged the monthly fee for the new service to which you have subscribed at the start of the next billing month. Monthly subscribers who wish to convert to an annual subscription may do so by canceling the monthly service and request in writing that their subscription be converted to an annual billing basis. Each subscriber is responsible for the subscription fees and any charges incurred to access NaviTrader.™

While using the Service, you may not:

1.) upload, post, publish, transmit, reproduce, or distribute in any way, information, software or other material obtained through the Service which is protected by copyright, or other proprietary or intellectual property right, or derivative works with respect thereto, without obtaining permission of the copyright owner or rightholder; or

2.) upload, post, publish, reproduce, transmit or distribute in any way any component of the Service itself or derivative works with respect thereto, as the Service is copyrighted as a collective work under U.S. copyright laws; or

You acknowledge and agree that we may terminate your password or account or deny you access to all or part of the Service without prior notice if you engage in any conduct or activities that we, in our sole discretion, believe violate any of these Terms and Conditions, violate the rights of NaviTrader™, or is otherwise inappropriate for continued access.

You acknowledge and agree that we may, in our sole discretion, deny you access, through NaviTrader™ to third party services, merchandise, materials or information on the Internet, and we shall have no responsibility to notify any third-party providers of services, merchandise or information nor any responsibility for any consequences resulting from lack of notification.

You agree to defend, indemnify and hold NaviTrader™ and its affiliates harmless from any and all claims, liabilities, costs and expenses, including reasonable attorneys' fees, arising in any way from your use of the Service or the placement or transmission of any message, information, software or other materials through the Service by you or users of your account or related to any violation of these Terms and Conditions by you or users of your account. The purchaser agrees that any and all disputes, mediation and/or litigation will be done in Hillsborough County, FL with the purchaser responsible for any and all costs, fees, expenses, legal and/or court costs. In the event the Purchaser has questions, concerns, constructive criticism, feedback or complaints related to NaviTrader, Purchaser agrees to communicate all such issues directly to NaviTrader, and agrees to make no public statements of such issues. The purchaser consents to the exclusive jurisdiction of the federal and state courts located in Hillsborough County, Florida, in any action arising out of or relating to this agreement. The purchaser waives any other venue to which the purchaser might be entitled by domicile or otherwise.

The Terms and Conditions and the relationship between you and NaviTrader™ shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. You and NaviTrader, Inc. each agrees to submit to the personal and exclusive jurisdiction of the courts located within the state of Florida.

The failure of NaviTrader™ to exercise or enforce any right or provision of the Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of the Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms and Conditions remain in full force and effect.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms and Conditions must be filed within 30 days after such claim or cause of action arose or be forever barred.
